Blanco Wilczynski Wins Reduction In Spousal Support For Business Client In Post-Judgment Divorce Trial

After a three-day trial, Derek Wilczynski won a reduction in spousal support for a business client who was seeking to reduce his spousal support obligation from $5,500.00 month. After hearing testimony regarding the 65 year-old client’s decline in business, that he was living off of his retirement savings (401k and pension accounts) and that he simply could not afford to pay $5,500.00, an Oakland County Circuit Court judge reduced the client’s spousal support obligation to $2,750.00 per month, half of what the client’s spouse had been seeking. The client’s business suffered a significant downturn in the past few years, and Mr. Wilczynski was able to present evidence to the court regarding this downturn. In addition, Mr. Wilczynski cross-examined the spouse’s expert witness at trial and was able to establish that there was no foundation for the expert’s opinions regarding the client’s business. The court’s reduction puts the client into a much better financial situation and hopefully will allow the client to focus on rebuilding the business.
